a) Hyperlinks

The USER and, in general, any individual or legal entity wishing to establish a hyperlink or other technical linking mechanism (such as links) from their Website to this Website (hereinafter, the “HYPERLINK”) must obtain the prior written authorisation of MES Tax Legal.

The establishment of a HYPERLINK shall under no circumstances imply the existence of any relationship between MES Tax Legal and the owner of the Website on which the HYPERLINK is included, nor the acceptance or approval by MES Tax Legal of its contents or products and/or services.

In any event, MES Tax Legal reserves the right to prohibit or disable any HYPERLINK to this Website at any time, particularly where the activity or content of the Website on which the HYPERLINK is included is unlawful.

  1. Failures, interruptions or damage caused by system faults, viruses, malware, interference or disconnections, or by the malfunctioning of the service or the Website.
  2. Information and content stored, including, by way of example but without limitation, in forums, chats, blog generators, comments, social media or any other medium that allows third parties to publish content independently on the Website. However, in accordance with Articles 11 and 16 of the Spanish Information Society Services and Electronic Commerce Act (LSSICE), MES Tax Legal makes itself available to all USERS, authorities and law enforcement agencies and actively cooperates in the removal or, where applicable, blocking of any content that may violate national or international legislation, third-party rights, public morals or public order. If the USER considers that any content on the Website may fall within this category, they are requested to notify us at [email protected].
  3. Unlawful acts by third parties by any means and/or improper or inappropriate conduct by the USER. In any event, MES Tax Legal shall not be liable for any damage caused by the actions or negligence of parties other than MES Tax Legal itself, whether or not such damage directly or indirectly affects the USER’s or third parties’ servers or other computer equipment.

The USER agrees to indemnify and hold harmless MES Tax Legal, its subsidiaries, affiliates, directors, officers, employees and collaborators from any claim or demand, including reasonable legal fees, brought by third parties as a result of the USER’s improper or unauthorised use of the Website and/or the services offered, the USER’s breach of the GENERAL TERMS, the PRIVACY POLICY, the COOKIE POLICY and/or, where applicable, the SPECIFIC TERMS, or any infringement of applicable legislation or third-party rights.

The USER and MES Tax Legal expressly submit to the jurisdiction of the Spanish courts and, specifically, to the courts of Barcelona, expressly waiving any other jurisdiction that may otherwise apply, unless applicable law mandatorily provides for a different jurisdiction or applicable law.

This waiver shall not apply to USERS who qualify as consumers, in which case jurisdiction shall lie with the courts of the USER’s place of residence.
